The City of Oakland in response to the increase of complaints of landlord harassment of tenants passed the tenant protection ordinance.
Harassment includes but is not limited to failing to provide housing services required by law, failing to perform repairs, abusing the owners right to access, attempting to influence tenant to vacate a rental unit through fraud, intimidation or coercion, interfering with a tenant's right to quiet use and enjoyment of a rental housing unit.
This Ordinance creates civil remedies for tenants who are experiencing unlawful behavior from their landlords.
The remedies include attorney fees, court costs, three times actual damages suffered by Tenant or a minimum of $1,000.00 whichever is greater. And at the discretion of the court, the tenant maybe awarded punitive damages.
This Ordinance is great for Oakland tenants.
